JOB PURPOSE/ROLE
Proactively provide legal advice and support to the Human Resources department and executives during investigation of ethics complaints. Act as trusted and confidential advisor for assigned internal business heads regarding legal issues relating to implementation of regional strategy, processes and products as it effects employee relations issues, Federal and State Employment Law and Department of Labor standards.
Ongoing regional expansions/restructuring issues and project work. Increasing requirements from the Group in terms of reporting and processes.
KEY RESPONSIBILITIES
LEGAL ADVICE-Proactively provide legal advice and support in relation to all employment and employee management issues.
Provide advice on employment related legal issues to all levels of management and staff of the Corporation and affiliates.
Identify potential legal issues related to employment practices and advise client/management
WORDING AND CONTRACTS-Proactively review and advice of employee handbook, code of conduct and contracts related to vendors providing services to Human resources.
Advise and draft employment contracts and other documents.
Provide guidance on employee related laws and issues that impact AGCS employees in foreign jurisdictions, such as laws specific to expat arrangement and Canadian Provinces.
Provide guidance and litigation management for employee related litigation within the Courts ( States and Federal) as well as the State and Federal Equal Employment Governing Bodies. Provide litigation support and guidance on employee related subpoenas and inquiries from State Department of Labor.
Provide Legal advice on employee issues relating to ADA, FMLA, Reasonable work accommodations and intermittent leaves.
KEY REQUIREMENTS/SKILLS/EXPERIENCE
Law degree;
Professional Legal qualification;
Minimum 10-15 years of practice in law firms or blue-chip companies;
Demonstrate expert experience of insurance or corporate law or litigation across multiple jurisdictions;
Proven track record of negotiation of complex legal agreements;
Fluent in English;
Experience in various business scenarios (restructuring, integration, growth);
Expert knowledge of an employment law and contract law/litigation process within the context of an employment law case;
Drafting and negotiating employment law contracts and strategic management of employment law contractual disputes;
Ability to research case law and statutes and apply the legal principle to the facts at hand;
Ability to negotiate best position for AGCS, and client, often in contentious situations, managing conflicting priorities of various parties
Ability to express ideas and messages clearly, both written and verbally.
